The EU General Data Protection Regulation (Regulation (EU) 2016/679), known in Germany as the DSGVO, applies directly in Germany.
It governs how your organization collects, uses, stores, and shares personal data: lawful basis, purpose, security, retention, and data subject rights. Server location covers only one part of compliance.
Germany's Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG) of 30 June 2017 supplements the GDPR with specific German regulations. For example, under Section 38 of the BDSG, a private company must appoint a Data Protection Officer (DPO) if it constantly employs, as a rule, at least 20 people dealing with automated data processing.
